Terms and Conditions of Use

These terms explain the use of Prop.vu, the responsibilities of subscribers and users, and the legal conditions that apply while using the web portal and mobile application.

1 Acceptance of Terms

Beleben Technologies LLP ("BELEBEN"), a limited liability partnership registered under the Limited Liability Partnership Act, has developed the product "Prop.vu" specifically for SUBSCRIBER business operations. "Prop.vu" comprises a web portal and a mobile application. Both components are integrated.

BELEBEN hosts this product via a third-party hosting provider under contract. All information submitted on our website or portal, including personal data, is stored on servers maintained by this third party.

Use of this website and portal constitutes agreement to these Terms and Conditions, except where otherwise agreed in writing. If not agreed, permission to use PRODUCT OWNER's website and portals is not granted.

References to "we," "us," or "our" mean BELEBEN and its subsidiaries. "You" or "your" means users of the website and portals.

2 Disclaimers

The website and portals are provided "as is" and "as available". BELEBEN expressly disclaims all warranties, express or implied, including merchantability and fitness for purpose.

BELEBEN does not warrant that the website, portal, servers, or emails are free of viruses or harmful components. BELEBEN is not liable for any damages from use or inability to use the product, except as may be required by applicable Indian law.

3 Portal Users

Portal users for this agreement include:

  • SUBSCRIBERS registered for "Prop.vu".
  • Users created by the SUBSCRIBER within the web portal.
  • Customers managed by the SUBSCRIBER.

4 System Access and Use

Access to web portal services requires SUBSCRIBER registration.

5 Registration

Registration requires payment of subscription charges as set out by BELEBEN.

  • The SUBSCRIBER's email address serves as the username.
  • Initial password is emailed to the SUBSCRIBER at registration.
  • Users may update profile data via the "Edit Developer's Profile" page.
  • Login credentials are non-transferable; the user is responsible for all activity.
  • Data collected is used for BELEBEN's services only and not shared with third parties.

6 Limitation of Liability

BELEBEN strives for 24x7 operational continuity, except for force majeure or scheduled maintenance, typically after 5 PM or on non-working days. Notices of extended downtime will be posted on the portal.

BELEBEN shall not be liable for any damages, losses, or legal consequences arising from the generation, management, usage, or disclosure of data owned by the SUBSCRIBER or its users.

All data-related activities remain the SUBSCRIBER's sole responsibility, and BELEBEN disclaims all legal or regulatory obligations in connection therewith.

7 Modifications

BELEBEN may modify portal content, features, or services at any time without notice and is not responsible for any consequences thereof.

8 Data Capture, Usage, and Ownership

SUBSCRIBERS and their authorized users are solely responsible for all data captured, generated, stored, processed, or used in their portals. All such data is exclusively owned by the SUBSCRIBER and users.

BELEBEN provides only the platform and technology and assumes no ownership, responsibility, or control over this data.

BELEBEN expressly disclaims all responsibility, liability, consequences, repercussions, litigation, or any other claims arising from or related to such data, including its generation, capture, storage, processing, use, or disclosure by the SUBSCRIBER or its users.

The SUBSCRIBER alone is fully responsible for compliance with all laws and regulations applicable to such data.

9 Data Security

Users utilize the portal at their own risk. BELEBEN is not liable for damages from unauthorized access, improper use, or inability to use data and web services.

Users are responsible for securing their IT systems, including virus protection. BELEBEN uses industry-standard security practices, but cannot guarantee users are free from virus exposure or hacking; users should scan files before uploading or downloading.

10 Intellectual Property Rights and Data Use

All portal data and databases are the exclusive property of BELEBEN and strictly protected under applicable Indian copyright and intellectual property laws. Users must fully comply with these laws.

Any unauthorized use, reproduction, transmission, publication, distribution, or display, including but not limited to taking screenshots, screen captures, or any form of copying and circulating such content to persons who are not authorized users of the system, is strictly prohibited and constitutes a violation of these laws.

BELEBEN reserves the right to take all necessary legal action, including civil and criminal proceedings, against any user engaging in such unauthorized activities. Any breach will result in immediate restriction, suspension, or termination of portal access and may expose the offending user to penalties under Indian law.

11 Trademarks

Removing or replacing BELEBEN's registered or unregistered trademarks is strictly prohibited.

13 General Terms of Use

  • Users may need to provide accurate ID or contact information during registration.
  • Users must comply with applicable law and regulation.
  • Unauthorized automated access, including bots, is prohibited.
  • Users may not interfere with portal operations or server networks.
  • Reproduction, republishing, or resale of portal content is forbidden.
  • Minimum age to use portals without supervision is 18 years; minors must have adult supervision.
  • Accounts are individual-use only; no shared or multiple accounts allowed.
  • Users must keep credentials confidential; BELEBEN is not liable for loss from compromised credentials.
  • BELEBEN may modify, suspend, or terminate accounts or access with or without notice.

14 Comments, Communication, and Content

Comment features are provided for users to share ideas, suggestions, or other communication. Such content:

  • Must be accurate and owned or controlled by the user.
  • Must not be illegal, obscene, defamatory, infringing, or contain malicious software or spam.

By submitting content, users grant BELEBEN a perpetual, global, royalty-free right to use, reproduce, modify, or distribute such content.

15 Privacy

16 Ownership, Copyright, and Trademark

All portal content, including trademarks, logos, text, graphics, software, and data, belongs to BELEBEN or its licensors and is protected by copyright laws. No license or right to use such content is granted without written consent.

17 Applicable Law

These Terms and Conditions are governed by the laws of India, regardless of conflict of law rules.

18 Breach of Terms

Any breach makes the user liable for misuse of data and any resulting losses or damages to the PRODUCT OWNER.

19 Jurisdiction

Disputes arising under these Terms and Conditions shall first seek amicable resolution. If unresolved, disputes are subject to the exclusive jurisdiction of the courts at Pune, Maharashtra, India.
